CAN-SPAM & Email Compliance Policy

Appraiser Guru™ by Tarnwick LLC · Last Updated: October 2026

1. Overview and Legal Basis

Tarnwick LLC complies with all applicable email marketing laws, including the CAN-SPAM Act of 2003 (15 U.S.C. § 7701-7713). This Policy explains which emails we send, how they are classified, and how opt-outs will be handled.

The CAN-SPAM Act imposes requirements on certain types of commercial emails but provides exemptions for transactional emails (emails necessary to the business relationship). This Policy explains which emails fall into which category.

2. Transactional Emails (CAN-SPAM Exempt)

2.1 Definition

Transactional emails are messages necessary to facilitate the business relationship between Tarnwick and the user. These emails are exempt from the opt-out requirements of the CAN-SPAM Act because they provide essential account and service information.

2.2 The Emails We Send

  • Account Confirmation: A link to activate your account when you sign up, and again if you ask us to resend it
  • Password Reset: A reset link when you request one
  • Email Address Change: A confirmation link when you change the email address on your account
  • Account Retention Notices: After your access ends or you ask us to delete your account, notices of how long you have to export your data before it is deleted, and a notice when deletion is complete
  • Supervisor Invitations: When a trainee names a supervisor, an invitation sent to that supervisor

2.3 No Unsubscribe Required

Transactional emails do not include an unsubscribe link because they carry information about your account that you need. Opting out of marketing email, if we send any, does not stop them.

3. Marketing and Commercial Emails (CAN-SPAM Compliant)

3.1 Definition

Marketing and commercial emails are messages intended to encourage the purchase of products or services, promote the platform, or communicate company news. These emails are subject to CAN-SPAM requirements.

3.2 We Do Not Currently Send Marketing Email

We currently send only service emails about your account and reports. We do not send newsletters, announcements, promotional offers, or any other marketing email, and every account is created as not opted in to marketing email. If we begin sending marketing email, it will include an unsubscribe link and we will honor opt-outs as the law requires.

4. Waitlist and Pre-Launch Emails

Before full public launch, Tarnwick keeps a waitlist of the email addresses people give us on our pre-launch page, so that we can tell them when we launch. Waitlist subscribers are not enrolled in any marketing email program. Each waitlist email includes an unsubscribe option.

5. Email Forwarding Feature

Each Appraiser Guru account has its own order address. You can give it to your clients or forward appraisal order emails to it from your own email, and each order email that arrives becomes a new order. This is a Service function, not marketing, and is not subject to CAN-SPAM opt-out requirements. Order intake by email is off until you turn it on, and you can turn it on or off at any time on your Profile page.

6. Referral Program Communications

Referral invitations are sent by individual members, not by Tarnwick on behalf of members. Each member is responsible for complying with CAN-SPAM requirements for their own referral communications, including obtaining prior consent, using accurate header information, providing a physical postal address, and honoring unsubscribe requests. The Acceptable Use Policy and Referral Program Terms prohibit spam and misleading marketing.

7. Required Information in All Commercial Emails

If we send marketing email, every marketing email from Tarnwick will include:

  • Clear sender identification (Tarnwick LLC)
  • Accurate, non-misleading subject line
  • Physical postal address (Tarnwick LLC, 1625 Ridge Rd, Highland, MI 48356)
  • Functioning one-click unsubscribe link
  • Unsubscribe requests honored within 10 business days
  • Clear identification as advertisement when applicable

8. Your Email Settings

You can change the email address on your account in Settings. There is no marketing email setting, because we do not send marketing email.

9. Your Data Rights

Your rights to access and correct your personal information are set out in Section 9, “Your Rights and Choices,” of our Privacy Policy.

10. Compliance and Remediation

If you believe you have received an email from Tarnwick that does not comply with this Policy or the CAN-SPAM Act, report it to info@tarnwick.com with the full email text, sender information, and date received.
